Yes. RCRA contains two citizen suit provisions which permit a party to file suit on behalf of the federal government as “private attorney generals” in order to enforce its provisions. An action under RCRA cannot be commenced until either sixty or ninety days after a plaintiff has given notice to the EPA, the state, as well as others of their intentions to file suit.
