Who qualifies as a fiduciary under CERCLA and the Texas SWDA?

A “fiduciary” is specifically defined to include, among other persons, one who is acting as a:

  • Trustee;
  • Executor;
  • Administrator;
  • Custodian;
  • Guardian of estates or guardian ad litem;
  • Receiver;
  • Conservator;
  • Committee of estates of incapacitated persons; and
  • Personal representative.
